Afghanistan Inquiry Legal Assistance Scheme

Overview

The Afghanistan Inquiry Legal Assistance Scheme funds the reasonable costs of legal representation for current and former serving Australian Defence Force members who are the subject of, or participating in, criminal investigations and prosecutions relating to matters arising from the Afghanistan Inquiry. This includes advice for the purposes of participating in Australian Federal Police (AFP)/Office of Special investigator (OSI) investigations, defending charges and giving evidence in Court if criminal proceedings are brought in relation to those matters.

Eligibility Criteria

ADF Membership
You must be a member or former member of the ADF.
Involvement in Investigation
You must be asked by the OSI or AFP to provide evidence, or be involved in criminal proceedings related to the AFP/OSI Afghanistan investigation.
Charged with a Crime
You must have been charged with a crime related to the AFP/OSI Afghanistan investigation.
PAP Notice
You must have been served with a Potentially Affected Person (PAP) Notice by the IGADF or similar notice.

•Retrospective costs are generally not payable unless it was not reasonable to anticipate the need for legal assistance.
•Compensation for loss of earnings or costs related to dealing with AGD is not covered.
